Unless it's an all-armor build, the P-38 gives you a better chance to activate Tides of War turn after turn.

After you kill one unit, you won't need the ToW. You might need the extra AT as the croc is only really good at short range.

Why wouldn't I need the ToW to gain an extra attack die? I get two attack dice from Fury after I kill the first enemy, but I have to keep killing one each turn to get the ToW.

Probably not, but any German army you face in a tourny is likely to have an Me-262 which shreds your Lightning and then goes after whatever infantry is left out in the open. The Croc is less playable by itself without any other Antitank units to cover it, a Tiger or a pair of Panzer IVs will likely be present and can chew it up at long range. This Greek army build is good, and would give most builds a run for their money to be sure, but it is much better against a mostly infantry army and lacks AT in a big way.
Here's another build that would give it fits:
22 Panzer IV F
22 Brummbar
19 Vet Panzer III
19 Me-262
16 Fallshirmjager x2
02 Barbed wire x4
Don't drop the paras till the lightning is dead, the wire should slow down the Greeks and spread them out a bit. The Panzers take on the Croc at long range, the Brummbar has a field day with all those bunched up infantry. And yes, I would bring this one to a tourny.
